ACCIDENT WAIVER & RELEASE OF LIABILITY CONTRACT

I, the undersigned participant in training sessions coached by TriathlonGold, hereby certify that I have a sufficient level of fitness to participate in the training sessions prescribed to me. I affirm that I am physically fit and have not been advised otherwise by a qualified medical professional. I acknowledge that open water and pool swimming, cycling, and running are potentially hazardous activities conducted in an uncontrolled open course environment, carrying the risk of serious injury or death. I voluntarily assume all risks associated with TriathlonGold training sessions and related activities, including but not limited to extreme physical exertion, falls, contact with other participants, event equipment, watercraft, vehicular traffic, potentially dangerous animals, and the effects of weather and cold water.

 

I accept full responsibility for the risks involved in completing TriathlonGold training sessions. I understand that liability may arise from negligence or carelessness on the part of the entities or individuals named below or from dangerous or defective equipment under their control. Having carefully read this waiver and fully understanding the risks, I agree to the following terms in consideration of my participation in TriathlonGold training sessions and related activities:

 

1. I hereby waive, release, and discharge from any and all liability for my death, disability, personal injury, property damage, or any other claims arising from my participation in TriathlonGold training sessions, including but not limited to TriathlonGold coaches, directors, employees, volunteers, representatives, agents, and sponsors.
    

2. I agree to indemnify and hold harmless the above-mentioned entities and individuals from any and all liabilities or claims resulting from my participation, whether caused by negligence or otherwise.
    

3. I grant permission for the use of my name, voice, and photographic/electronic image for promotional or other purposes without compensation.

 

I certify that I agree to all terms and conditions outlined in this contract. I acknowledge that this accident waiver and release of liability will be utilized by TriathlonGold and will govern my actions and responsibilities while participating in TriathlonGold training sessions. This waiver shall be interpreted broadly to provide a release and waiver to the maximum extent permissible under applicable law. I confirm that I have read and fully understand this contract without exception.
